Broadband Services. Notwithstanding any other provision of the Amended Agreement (but subject to and without limiting Section 2 above and Section 4.4 below), when RCN-B seeks access to a Hybrid Loop for the provision of "broadband services," as such term is defined by the FCC, then in accordance with 47 C.F.R. § 51.319(a) and the Arbitration Orders, Verizon shall provide RCN-B with nondiscriminatory access under the Amended Agreement to the existing time division multiplexing features, functions, and capabilities of that Hybrid Loop, including DS1 or DS3 capacity (where impairment has been found to exist, which, for the avoidance of any doubt, does not include instances in which Verizon is not required to provide a DS1 Loop under Section 3.4.1 below or is not required to provide a DS3 Loop under Section 3.4.2 below) on an unbundled basis to establish a complete transmission path between the Verizon central office serving an end user and the end user's customer premises. This access shall include access to all features, functions, and capabilities of the Hybrid Loop that are not used to transmit packetized information.
Broadband Services. When CLEC seeks access to a Hybrid Loop for the provision of broadband services, including DS1 or DS3 capacity, but not DSL, Qwest shall provide CLEC with non-discriminatory access on an unbundled basis to time division multiplexing features, functions, and capabilities of that Hybrid Loop, only where impairment has been found to exist to establish a complete transmission path between Qwest's Central Office and an End User Customer's premises. This access shall include access to all features, functions, and capabilities of the Hybrid Loop that are not used to transmit packetized information.
Broadband Services. When CLEC seeks access to a Hybrid Loop for the provision of broadband services, including DS1 or DS3 capacity, but not DSL, CenturyLink shall provide CLEC with non-discriminatory access on an unbundled basis to time division multiplexing features, functions, and capabilities of that Hybrid Loop, only where impairment has been found to exist to establish a complete transmission path between CenturyLink's Central Office and an End User Customer's premises. This access shall include access to all features, functions, and capabilities of the Hybrid Loop that are not used to transmit packetized information.
Broadband Services. Notwithstanding any other provision of the Amended Agreement (but subject to and without limiting Section 2 above) or any Verizon Tariff or SGAT, when NetCarrier seeks access to a Hybrid Loop for the provision of "broadband services," as such term is defined by the FCC, then in accordance with, but only to the extent required by, 47 U.S.C. § 251(c)(3) and 47 C.F.R. Part 51, Verizon shall provide NetCarrier with unbundled access under the Amended Agreement to the existing time division multiplexing features, functions, and capabilities of that Hybrid Loop (but no features, functions or capabilities used to transmit packetized information) to establish a complete time division multiplexing transmission path between the main distribution frame (or equivalent) in a Verizon wire center serving an end user to the demarcation point at the end user's customer premises.
Broadband Services. The provisions of this clause 12 shall apply where the Broadband Service is provided by Us.
12.1 We can only supply the Broadband Service to You if:
12.1.1 You have an existing line or one is installed by Us;
12.1.2 each PC to be connected to the Broadband Service is of a minimum specification, which an Authorised Person will advise to You;
12.1.3 You have the necessary ancillary equipment such as telephone sockets, modems and compatible extension leads and cables;
12.1.4 You pass any credit check which We carry out;
12.1.5 You provide Us with correct and complete information as part of the process to register You for the Broadband Service.
12.2 If You cannot satisfy the requirements of clause 12.1 or if the Broadband Service cannot reasonably be supplied to the Property having due regard to any technical issues arising and the parties cannot agree a resolution of the problems, then either party may terminate this Agreement by giving to the other party 14 days notice in writing.
12.3 We will offer a Technical Support Helpline to provide information and advice to You on any technical issues relating to Your use of the Broadband Service. Calls to the Technical Support Helpline are charged at premium rate. All calls may be monitored and recorded for training and security purposes
12.4 Given that We do not produce the information, results, sound, software or any other materials and services made available to You as part of the Broadband Service ("the Content"), We do not guarantee or warrant the completeness or accuracy of the Content.
12.5 You must ensure that passwords and user names used in connection with the Broadband Service are kept confidential and are only used by You or people authorised by You. You must inform Us immediately if You know or suspect that a user name or password has been disclosed to an unauthorised person or is being used in an unauthorised way. You must not change or attempt to change a user name without Our written consent.
12.6 We reserve the right to:
12.6.1 suspend user names and password access to the Broadband Service if at any time We think that there has been or is likely to be a breach of security;
12.6.2 ask You to change any or all of the passwords You use in relation to the Broadband Service.
12.7 We do not guarantee that the Broadband Service is secure and We do not guarantee the prevention or detection of any unauthorised attempts to access the Broadband Service.

Subject to the conditions set forth in Section 1 of this Attachment, when Intrado seeks access to a Hybrid Loop for the provision of "broadband services", as such term is defined by the FCC, then in accordance with, but only to the extent required by, the Federal Unbundling Rules, Verizon shall provide Intrado with unbundled access to the existing time division multiplexing features, functions, and capabilities of that Hybrid Loop, including DS1 or DS3 capacity (but only where impairment has been found to exist, which, for the avoidance of any doubt, does not include instances where Verizon is not required to provide unbundled access to a DS1 Loop or a DS3 Loop under Section 1 of this Attachment) to establish a complete time division multiplexing transmission path between the main distribution frame (or equivalent) in a Verizon End Office serving an end user to the demarcation point at the end user's Customer premises. This access includes access to all features, functions, and capabilities of the Hybrid Loop that are not used to transmit packetized information.

Broadband Services. Broadband Services" shall mean the services ------------------ provided by Xxxxx 0 to Customer originating in the United States hereunder. Broadband Services shall include (a) a local ethernet connection for distribution of content to other networks on the local ethernet in a Gateway Facility, (b) InterGateway transport, with traffic terminating to any customer on the Level 3 Network or any Level 3 peer through non-paid peering points, and (c) transit services, with traffic terminating to Level 3 transit connections.
Broadband Services are transferable between telecommunications lines where there is a change of property address and a new line is being installed.
