Minimum Specifications. Shipper's Gas delivered into the Gathering System shall be commercially free from liquids of any kind, air, dust, gum, gum forming constituents, harmful or noxious vapors, or other solid or liquid matter which, in the sole judgment of Gatherer, may interfere with the merchantability of Shipper's Gas or cause injury to or interfere with proper operation of the lines, regulators, meters or other equipment of the Gathering System. Shipper's Gas shall also conform to applicable quality specifications of the receiving pipeline at each applicable Delivery Point.
Minimum Specifications. Following are the minimum specifications pertaining to this Contract:
1. The avoided unit (“Avoided Unit”) options on which this Contract is based are detailed in Appendix A.
2. This offer shall expire on April 1, 2021.
3. The date by which firm capacity and energy deliveries from the QS to FPL shall commence is the in-service date of the Avoided Unit (or such later date as may be permitted by FPL pursuant to Section 5 of this contract) unless the QS chooses a capacity payment option that provides for early capacity payments pursuant to the terms of this Contract.
4. The period of time over which firm capacity and energy shall be delivered from the QS to FPL is as specified in Appendix E; provided, such period shall be no less than a minimum of ten (10) years after the in-service date of the Avoided Unit.
5. The following are the minimum performance standards for the delivery of firm capacity and energy by the QS to qualify for full capacity payments under this Contract: On Peak * All Hours * QS Performance and On Peak hours shall be as measured and/or described in FPL’s Rate Schedule QS-2 attached hereto as Appendix A (Continued on Sheet No. 9.032.1)
Minimum Specifications. Where the Service is successfully activated, but You are unable to use the Service because either (i) You have not met the Minimum Specifications We informed You of during the registration process; or (ii) You have not purchased or installed suitable Equipment, which will be determined solely by Us, then You will incur Charges from the date the Service is activated; and We will not be responsible for any Equipment or any other products that You have purchased but cannot use. You will continue to incur Charges until You have terminated Your Agreement in accordance with these terms.
Minimum Specifications. 2.1 Hull – Eastern 27 Custom, Xxxxxx 2520XL or Xxxxxxx Craft 28 DV Miami or approved equal by the Client Agency.
Minimum Specifications. Company's server on which the Tracked Pages will be hosted, and from which the Tracked Pages will be accessed by Users, shall at all times meet the following minimum specifications: no page of the Tracked Pages shall have a download time of more than sixty (60) seconds at a modem speed of 28.8 kbps.

3.2.1 Design, construct, and maintain the Facility in accordance with this Contract, applicable law, regulatory, and governmental approvals, any requirements of warranty agreements or similar agreements, prudent industrypractice, insurance policies, and the Interconnection Agreement or Wheeling Agreement.
3.2.2 Perform all studies, pay all fees, obtain all necessary approvals and execute all necessary agreements (including the Interconnection Agreement or the Wheeling Agreement(s)) in order to schedule and deliver the firm capacity and energy to FPL.
3.2.3 Obtain and maintain all permits, certifications, licenses, consents or approvals of any governmental or regulatory authority necessary for the construction, operation, and maintenance of the Facility (the “Permits”). QS shall keep FPL reasonably informed as to the status of its permitting efforts and shall promptly inform FPL of any Permits it is unable to obtain, that are delayed, limited, suspended, terminated, or otherwise constrained in a way that could limit, reduce, interfere with, or preclude QS’s ability to perform its obligations under this Contract (including a statement of whether and to what extent this circumstance may limit or preclude QS’s ability to perform under this Contract.)
3.2.4 Demon...
Minimum Specifications. Operator retains at all times under the term of this Agreement the right to establish and/or change Operator’s minimum specifications, subject to Section 28(a), for any Product introduced at the Berths with thirty (30) days advance notice to Customer. Changes will not affect previously accepted nominated volumes unless immediate action is required by Applicable Law. Operator’s Minimum Specifications shall allow the throughput of the grades and approximate qualities of crude oil specified in Annex D.
Minimum Specifications. TLO retains at all times under the term of the Agreement the right to post and make reasonable changes to minimum specifications for Product introduced or stored at the Amorco Assets, to conform to then current law, permits, leases, regulations or operational requirements, with thirty (30) advance notice to TRMC. Changes will not affect previously accepted nominated volumes unless immediate action is required by Applicable Law. Notwithstanding the foregoing, TRMC is subject to any minimum specifications specified in the Agreement, if any.
Minimum Specifications a) You must supply, operate and maintain hardware and software that meet the Minimum Specifications at all times.
b) We have the right to alter the Minimum Specifications so that they take effect immediately upon the expiry of the current Licence Period.
Minimum Specifications. Customer will ensure that any and all of Customer’s Product delivered to the Terminal under the terms of this Agreement meets the following specifications: Sulfur (percent by weight): maximum four percent (4.0%)
