BUILDING AGREEMENT. SUSPENSIVE CONDITION
BUILDING AGREEMENT. The Purchaser acknowledges that the Property is sold on a plot and plan basis and that simultaneously with the signing hereof he will enter into a building agreement with a building contractor. The Seller has appointed a preferred building contractor, TGP Building (Pty) Ltd, for the construction of houses in the development.
BUILDING AGREEMENT. 6.2.1. This Agreement is subject to the Building Agreement being entered into simultaneously with signature of this Agreement.
6.2.2. Consequently, should the Building Agreement be cancelled or terminated for any reason whatsoever, then and in that event this Agreement shall also be cancelled or terminated and shall be of no further force or effect. Sale Agreement
BUILDING AGREEMENT. The Parties acknowledge that it is a material term of this Agreement that the Purchaser is hereby obliged to enter into a building agreement with the Contractor immediately upon signature of this Agreement, which building agreement shall ensure compliance with the dwelling type and various specifications more fully referred to therein, the content of which the Purchaser acknowledges himself to be fully aware of.
BUILDING AGREEMENT. 24.1.1. This Agreement is subject to the condition precedent that the Contractor and the Purchaser must enter into a Building Agreement in respect of the construction of a dwelling on the Erf on the Signature Date, which Building Agreement must in writing and signed by the abovementioned parties.
24.1.2. In the event of this condition not being fulfilled, this Agreement will be automatically cancelled, and the Parties will have no claim against each other.
BUILDING AGREEMENT. The Purchaser acknowledges that the Property is sold on a plot and plan basis and that simultaneously with the signing hereof he will enter into a building agreement with a building contractor. The Seller has appointed a preferred building contractor, TGP Construction (Pty) Ltd, for the construction of houses in the development which resulted in a lower than market related building price. Because this builder also builds other houses in the development he will be permanently on site and readily available for any queries and questions that the Purchaser may have during the construction phase. Although the Purchaser has a freedom of choice to appoint his own contractor he herewith acknowledges the convenience and economic benefit in appointing TGP Construction (Pty) Ltd as the building contractor.
BUILDING AGREEMENT. (1) it will promptly and diligently perform and comply with the obligations on its part contained in the Building Agreement, remedy any breach of its obligations under the Building Agreement, notify the Security Trustee of any breach of or default of which it has knowledge under the Building Agreement and institute and prosecute all such proceedings as may be necessary or reasonably advisable to preserve or protect its interests and the interests of the Security Trustee in the Building Agreement, and (2) it will at its own cost and expense use commercially reasonable efforts to obtain the grant to it of the Lease pursuant to the Building Agreement and will promptly upon the grant of the Lease, notify the Security Trustee of such grant;
BUILDING AGREEMENT the Building Agreement constitutes valid, binding and enforceable obligations of the Assignor, are in full force and effect and have not been varied or modified in any respect from the form in which they were entered into, or cancelled, and neither it nor, to the best of the Assignor's knowledge, the Lessor, is in default thereunder or has asserted or threatened to assert any right of termination or repudiation thereof or any right of re-entry; and
BUILDING AGREEMENT. 22.3.1 This Agreement is furthermore subject to the condition precedent in that the Building Agreement must be concluded and signed by the Parties thereto on the Signature Date.
22.3.2 In the event of this condition not being fulfilled, this Agreement will become null and void and be of no further force or effect.

11.1. The Purchaser acknowledges that the Property is sold on a plot and plan basis and that this agreement is subject to the Purchaser, simultaneously with the signing hereof, entering into a building agreement with the Seller’s building contractor, TGP Construction Cape Town (Pty) Ltd, for the construction of houses in the Development.
11.2. In the event that this suspensive condition is not fulfilled, this Agreement shall lapse and be of no further force or effect.
