Building Condo Regime. Xxxxxxxx has advised Xxxxxxxxxx Representative that the Building Condo Regime will be established after the Closing Date. Upon the establishment of the Building Condo Regime, Borrower shall promptly provide Bondholder Representative with the filed Declaration and all formation and other documents and agreements relating to the Building Condo Regime, and, at Borrower’s sole cost and expense, all amendments to the Security Instrument and other Financing Documents as Bondholder Representative may require (or agree to at Bondholder Representative’s request) as a result of the formation of the Building Condo Regime to provide for Bondholder Representative’s lien against all of the Improvements and upon Bondholder Representative’s receipt thereof, Bondholder Representative will execute and deliver, as applicable, counterparts of all such amendments. Borrower will submit to Bondholder Representative all budgets, assessments and special assessments promptly after the adoption thereof by the Board of Directors of the Building Condo Regime (which budgets shall in any event be consistent with the planned development of the Premises as provided for in this Agreement).‌

  • Building Permits All building permits required for the construction of the Improvements have been obtained prior to the commencement of the construction of the Improvements and copies of same will be delivered to Lessor.
