BUS DIVERSION. 3.1 The Owners covenant with the Council: (a) not to Occupy more than 20 Dwellings within the Development until they have procured and funded the provision of the Bus Diversion; and (b) to fund the continued provision of the Bus Diversion for a period of five years from the date of Occupation of the 20th Dwelling within the Development. 3.2 If on the fifth anniversary of Occupation of the 20th Dwelling the Modal Shift has not been achieved, the Owners covenant with the Council to fund the continued provision of the Bus Diversion for a further period of two years. 3.3 Prior to commencement of the Bus Diversion, the Owners covenant with the Council to procure and fund the Bus Stop Relocation.
