BUSINESS ASSOCIATE AGREEMENT TERMS AND CONDITIONS. To the extent Contractor is a business associate as defined under the Federal Health Insurance Portability and Accountability Act (“HIPAA”) and the HITECH Act, Contractor shall comply with the additional terms and conditions set forth in this Exhibit (“M”) to the Professional Services Contract (“PSC” or “Contract”). This Business Associate Agreement Exhibit “M” supplements and is made a part of the Contract by and between the County of Marin, referred to herein as Covered Entity (“CE”), and , referred to herein as Business Associate (“BA”), to which this Exhibit “M” is an incorporated attachment.
