Common use of Bypass Flow Clause in Contracts

Bypass Flow. Permittee shall ensure that Permittee’s diversion facility passes sufficient flow at all times to keep fish below the facility in good condition. If at any time the diversion rate identified in subsection (e)(4)(A) cannot be maintained, Permittee shall cease diversion and all natural flow shall be allowed to bypass the point of diversion.
