CALCULATION OF LATE-PAYMENT INTEREST. [Late-payment] interest shall be calculated based on the number of Days that have passed between the due date for any amount owed by the Borrower and (but excluding) the date on which it was actually repaid, based on a three-hundred-sixty-(360) Day year. Application of late-payment interest shall not be construed as granting additional time for payment, nor as waiving any right arising under this Agreement and, in particular, the acceleration clauses set forth in Article 16 shall remain in effect. The Local Agent and Banks waive late-payment interest in the event that the Local Agent. acting on behalf of the Banks, the Arranger, the International Agent, and the Local Agent, does not enforce one or more of the guaranties in Clauses 11.2 through 11.4 within 30 Days following the observation of a default in payment of all amounts due and payable by the Borrower.

  • Late Payment Interest If Lessee fails to pay any amount payable under the Lease on the due date, Lessee will pay on demand from time to time to Lessor interest (both before and after judgement) on that amount, from the due date to the date of payment in full by Lessee to Lessor, at the Interest Rate.   • Late Payment Rent Late payment by Tenant to Landlord of Rent and other sums due will cause Landlord to incur costs not contemplated by this Lease, the exact amount of which will be extremely difficult and impracticable to ascertain. In addition to the late charge, Rent not paid when due shall bear interest at the Default Rate from the 5th day after the date due until paid.
