California Proposition 65 Compliance Sample Clauses

California Proposition 65 Compliance. Seller represents and warrants that, if applicable, the Goods supplied under the Order comply with California Health and Safety Code Section 25249.5 et seq., commonly referred to as Proposition 65 ("Prop 65"). Buyer sells its Goods nationally across the United States, including California, either directly or indirectly through distributors or original equipment manufacturers that incorporate Buyer’s Goods into their products. Seller shall (1) notify Buyer of any and all Goods manufactured by Seller for Buyer, or supplied by Seller to Buyer, that contain substances listed in Prop 65 that require a Prop 65 warning; or (2) certify that Goods manufactured by Seller for Buyer, or supplied by Buyer to Seller, do not contain substances listed in Prop 65 and thus do not require a Prop 65 warning.
