CANADIAN PACIFIC RAILWAY. Purchasers/Tenants are advised that any berm, fencing, or vibration isolation features implements are not to be tamper with or altered, and further to that the owner shall have the sole responsibility for and shall maintain these features. Purchasers/Tenants are advised that the 1.83 metre high chain link security fence to be constructed by the developer and maintained along the common property line of the Railway and the development shall be maintained in a satisfactory conditions by the owners at their expense. Purchasers/Tenants within 300m of the railway right-of-way are advised of the existence of the Railway's operating right-of-way; the possibility of alterations including the possibility that the Railway may expand its operations, which expansion may affect the living environment of the residents notwithstanding the inclusion of noise and vibration attenuation measures in the design of the subdivision and individual units, and that the Railway will not be responsible of complaints or claims arising from the use of its facilities and/or operations.

CANADIAN PACIFIC RAILWAY. 25. (1) The Owner covenants and agrees to include a clause in all Agreements of Purchase and Sale advising prospective purchasers within 300 m of the Canadian Pacific Railway right-of-way that the Canadian Pacific Railway will not take responsibility for complaints as a result of noise, vibration, air quality, generated by the present and/or future operations.

  • WSIB & LTD An Employee who is receiving benefits under the Workplace Safety and Insurance Act, or under a LTD plan, is not entitled to benefits under a school board’s sick leave and short term disability plan for the same condition unless the employee is on a graduated return to work program then WSIB/LTD remains the first payor. For clarity, where an employee is receiving partial benefits under WSIB/LTD, they may be entitled to receive benefits under the sick leave plan, subject to the circumstances of the specific situation. During the interim period from the date of the injury/incident or illness to the date of the approval by the WSIB/LTD of the claim, the employee may access sick leave and short term leave and disability coverage. A reconciliation of sick leave deductions made and payments provided, will be undertaken by the school board once the WSIB/LTD has adjudicated and approved the claim. In the event that the WSIB/LTD does not approve the claim, the school board shall deal with the absence consistent with the terms of the sick leave and short term leave and disability plans.
