Common use of Cancellation and Return Policy Clause in Contracts

Cancellation and Return Policy. Users and Employee Accounts may cancel a new line of Service within 30 days of activation (“Cancellation Period”), if the User: (a) contacts Contractor to cancel Service; and (b) returns the Like New Product (defined below) through Purchasing Entity’s Contractor account representative, or team, or location from which it was purchased with proof of purchase. The “Return Period” is thirty (30) calendar days from the Product’s purchase date. Only Like New Products returned with proof of purchase to Purchasing Entity’s Contractor account representative or team or location from which it was purchased within the Return Period are eligible for a refund of the purchase price. A “Like New Product” is a Product purchased from Contractor that is in its original packaging with all original contents, undamaged, and in good working condition with no material alterations to the Product’s hardware or software, as determined by Contractor in its sole discretion. Purchasing Entity may be required to pay a commercially reasonable restocking fee for failing to return a Product with included packaging, manuals or accessories, or if the Product returned is in a damaged, altered or destroyed condition. Even if Purchasing Entity cancels Service and/or returns any Product as provided herein, Purchasing Entity must pay all Service and usage Charges incurred thru the end of Purchasing Entity’s Service term or return date and any applicable subsequent penalties or assessments. If a User attempts to cancel Service, but does not return the applicable Product or if such Product is returned in a damaged, altered or destroyed condition, Contractor may take one or more of the following actions: (i) prevent such Product from working on any network; (ii) charge an early termination fee (if such line of Service is subject to an early termination fee); (iii) elect not to process Service cancellation; or (iv) charge such User the suggested retail price or the cost to repair the applicable Product, (which may be greater than the price paid for such Product), plus any shipping and handling charges. Except for the 30-calendar day Return Period, the cancellation and return policies in this Section 13 will not apply to Users who purchase Product(s) through Contractor’s EIP or a Contractor leasing program and the terms of that program’s agreement will supersede and control the purchase or lease of those Products.

Cancellation and Return Policy. Users and Employee Accounts Customer may cancel a new line of Service within 30 days of activation (“Cancellation Period”)or change an order by mutual agreement with BTI up to two weeks prior to the scheduled delivery date without penalty. Order cancellation requests must be submitted to BTI in writing. No order cancellation or change will be accepted without written consent from BTI. In the event such orders or the related specifications are modified, the costs incurred thereby shall be added to the purchase price. If the Customer cancels an order, and the order covers items, parts, or services rendered that are specially made to the Customer’s specifications, the Customer shall immediately pay for such items, parts, materials, and services, if already completed or procured by BTI as of the User: (a) contacts Contractor date of cancellation. If Customer for any reason fails to take delivery, Customer shall make payment as though delivery had been made and BTI may store goods for Customer’s account and at Customer’s expense and risk. BTI also reserves all claims for damages and other remedies upon cancellation of any order or breach of these terms and conditions from Customer. BTI shall be entitled, in the event of bankruptcy or insolvency of Customer, or in the event any proceeding is brought against Customer under bankruptcy or insolvency laws, to cancel Service; any order then outstanding and (b) returns receive reimbursement for BTI’s losses of the Like New cancellation. Customer may request to return Product (defined below) through Purchasing Entity’s Contractor account representative, or team, or location from which it was purchased with proof of purchase. The “Return Period” is within thirty (30) calendar days from the Productof Delivery Date and contingent upon BTI approval. Customer must submit their return request to BTI for approval. If BTI approves Customer’s purchase datereturn request, BTI will issue an RMA number to Customer authorizing return. BTI will not accept any delivery of a return without an authorized RMA number. Customer shall pay a twenty- five percent (25%) restocking charge on any unwanted Product returned to BTI. Only Like New Products new and unused Product returned with proof of purchase to Purchasing Entity’s Contractor account representative or team or location from which it was purchased within the Return Period are eligible for a refund of the purchase price. A “Like New Product” is a Product purchased from Contractor that is in its original packaging with all its original contentsseal intact and unopened is eligible for return. In the event Customer’s returned Product does not satisfy this criterion, undamaged, and in good working condition with no material alterations to BTI retains the Product’s hardware or software, as determined by Contractor in its sole discretion. Purchasing Entity may be required to pay a commercially reasonable restocking fee for failing right to return a Product with included packaging, manuals to Customer at their expense and deny approval of Product for return. Special order or accessories, or if the Product returned is in a damaged, altered or destroyed conditioncustom-built Products are NOT eligible to return. Even if Purchasing Entity cancels Service and/or No returns any Product as provided herein, Purchasing Entity must pay all Service and usage Charges incurred thru the end of Purchasing Entity’s Service term or return date and any applicable subsequent penalties or assessments.
