Capacity Test Procedures. Each Capacity Test shall be conducted in general accordance with ASME Performance Test Code 46 for Combined Cycle facilities, ASME Performance Test Code 22 for simple cycle Gas Turbine facilities and ASME Performance Test Code 17 for Recprocating Internal Combustion Engine facilities and in accordance with the following procedures (“Test Procedures”): [For other types of Units, other testing procedures Buyer may specify other standards.] (i) The Capacity Test shall consist of three (3) one-hour test periods. For each one-hour test period, the data will be averaged and corrected back to ISO Conditions as well as Peak July Conditions if the test was conducted during a Summer Month. The Capacity of the Units will be the arithmetic average of the three corrected test results. (ii) The Units shall be operated [with all combustion turbines operating simultaneously at Base Load and also with duct firing (“Peak Load”), as applicable]. The Units shall be operating in steady state with all equipment in normal operating service. [For facilities other than combined cycle technology, substitute “simultaneous and individually” for the bracketed language. Facilities that have multiple operating modes may be subject to additional testing requirements as necessary to test the full range of capability of the Units.] (iii) The Energy output of the Units during the Capacity Test shall be measured by the Electric Revenue Meter at the Electrical Delivery Point. (iv) The Capacity of a Unit as demonstrated by a Capacity Test (“Tested Capacity”) shall be the metered Energy output of such Unit per hour (measured in megawatts), adjusted to (A) ISO Conditions if the Capacity Test occurs in a Non-Summer Month and (B) Peak July Conditions if the Capacity Test occurs in a Summer Month, in the case of each of clauses (A) and (B), by using standard and accepted engineering methods. The determination of the Tested Capacity shall be done by Seller. The Capacity Test results shall be delivered to Buyer no later than 48 hours after the completion of the Capacity Test. (v) Buyer may have a representative present at the Site at any time during the Capacity Test. (vi) Capacity Testing shall be conducted contiguously with the testing required pursuant to Section 4.2. (vii) The Parties shall provide for additional procedures and protocols related to Capacity Testing, consistent with the principles set forth above, in the Operating Procedures, which shall be additional “Test Procedures.” (viii) Capacity Testing shall not be conducted during a Scheduled Maintenance Outage.

(ii) The Capacity Test shall consist of three six (36) one-half-hour test periods. For each one-half-hour test period, the data will be averaged and corrected back to ISO Conditions as well as Peak July Conditions if the test was conducted during for a Summer Month. The Capacity of the Units will be the arithmetic average of the three six corrected test results. (iiiii) The Units shall be operated [with all combustion turbines operating simultaneously at Base Load and also with duct firing (“Peak Load”), as applicable]. The Units shall be operating in steady state with all equipment in normal operating service. (ivv) The Capacity of a Unit as demonstrated by a Capacity Test (“Tested Capacity”) shall be the metered Energy output capacity, net of auxiliary loads and station use, of such Unit per hour (measured in megawatts), adjusted to (A) ISO Conditions if the Capacity Test occurs in or pertains to a Non-Summer Month and (B) Peak July Conditions if the Capacity Test occurs in or pertains to a Summer Month, in the case of each of clauses (A) and (B), by using standard and accepted engineering methods. The determination of the Tested Capacity shall be done by Seller. The Capacity Test results shall be delivered to Buyer no later than 48 forty-eight (48) hours after the completion of the Capacity Test. (vvi) Buyer may have a representative present at the Site at any time during the a Capacity Test, or alternatively, at Buyer’s request, all necessary and requested test information shall be provided to Buyer without the need of a Buyer representative on Site. Buyer has the right to require Seller’s test engineer to be on site for the duration of the test. (vivii) Capacity Testing shall be conducted contiguously contemporaneously with the testing required pursuant to Section 4.2. (vii) The Parties shall provide for additional procedures and protocols related to Capacity Testing, consistent with the principles set forth above, in the Operating Procedures, which shall be additional “Test Procedures.” (viii) Capacity Testing shall not be conducted during a Scheduled Maintenance Outage.
