Notwithstanding anything to the contrary in Section 4.03(b) of the Pooling and Servicing Agreement or in the Series 2002-CC Supplement, the Indenture or this Indenture Supplement, if DCS no longer maintains a short-term rating from either Standard & Poor's or Moody's, DCS may continue to make monthly net deposits of Collections xxxx xhe Collection Account in accordance with Section 4.03(b) of the Pooling and Servicing Agreement so long as (i) DCS remains the Servicer under the Pooling and Servicing Agreement, (ii) no Service Default has occurred and is continuing and (iii) DaimlerChrysler North America Holding Corporation maintains a short-term rating of at least A-1 by Standard & Poor's and P-1 by Moody's (and has maintained such short-term ratings for five Business Xxxx xollowing any reduction of either such rating).
