Certificates and Permits. For employees who have established seniority and are chosen by the Company to perform work which requires certificates or permits by Governmental regulations, the Company agrees, during the term of this Agreement, to pay for the initial issue and annual renewal of those certificates or permits upon receiving documentation from the employee that he/she has successfully obtained the initial certificate. It is agreed that employees required by the Company to obtain a driver’s licence of a higher category than “G” would be allowed reasonable time off, with pay, and the required equipment to complete the applicable Government examination. Furthermore, the Company will pay the examination and medical fees, if any, associated with the obtainment and annual renewal of these licences for the designated employees. The foregoing payments are based on documented successful completion and obtainment of the required licence.

The Company and its subsidiaries possess all certificates, permits and other authorizations issued by the appropriate federal, state or foreign governmental or regulatory authorities that are necessary for the conduct of their respective businesses, except where the failure to possess the same would not, individually or in the aggregate, have a Material Adverse Effect; and neither the Company nor any of its subsidiaries has received notice of any proceedings related to the revocation or modification of any such certificate, permit or authorization or has any reason to believe that any such certificate, permit or authorization will not be renewed in the ordinary course, except where such revocation, modification or nonrenewal would not, individually or in the aggregate, have a Material Adverse Effect.

Permanent employees who have passed their probationary period who are required by the Employer to maintain certificates (such as Field Safety Representative or High Voltage Close Proximity) as a condition of their employment or to hold and maintain permits (such as the Electrical Permit Holder) shall be reimbursed such costs upon presentation of proof of payment.

Certificates and Permits. Vendor shall secure at Vendor’s own expense all necessary certificates and permits from any applicable governmental or administrative agency required in connection with the work contemplated by this Agreement or any part of this Agreement, and shall give all notices required by law, ordinance or regulation. Vendor shall pay all fees and charges incident to the due and lawful prosecution of the work contemplated by this Agreement, and any additional work performed by Vendor on behalf of NHA.

The Company and each Subsidiary possesses all licenses, certificates, permits and other authorizations issued by, and have made all declarations and filings with, the appropriate federal, state, local or foreign Regulatory Agencies having jurisdiction over the Company that are necessary for the ownership or lease of their respective properties or the conduct of their respective businesses as described in the Registration Statement and the Prospectus, except where the failure to possess or make the same would not, individually or in the aggregate, reasonably be expected to have a Material Adverse Effect; and the Company has not received written notice of any revocation or modification of any such license, certificate, permit or authorization, except where such revocation or modification would not, individually or in the aggregate, reasonably be expected to have a Material Adverse Effect.
Certificates and Permits. Tenant shall not at any time use or occupy, or permit anyone to use or occupy, the Demised Premises, or do or permit anything to be done in the Demised Premises, in violation of the Certificate of Occupancy which is annexed hereto as Exhibit F and made a part hereof (or any comparable certificate which may at any time be required for such purpose by laws and/or requirements of public authorities), for the Demised Premises and for the Building or in violation of any covenant as to use or exclusivity of use contained in any other lease in the Building. If any governmental license or permit, other than a Certificate of Occupancy, shall be required for the proper and lawful conduct of Tenant's business in the Demised Premises, or any part thereof, or if failure to obtain or maintain any license or permit by Tenant would in any way affect Landlord, Tenant, at its expense, shall duly procure and thereafter maintain such license or permit and submit the same for inspection by Landlord. Tenant shall at all times comply with the terms and conditions of each such license or permit. Landlord agrees not to amend the Certificate of Occupancy in a manner which prohibits the Permitted Use under this lease.
Certificates and Permits. (a) Mortgagor has, and shall maintain (i) all necessary certificates, licenses, authorizations, registrations, permits and/or approvals necessary for the operation of all or any part of the Premises and the conduct of Mortgagor's business at the Premises, and (ii) all required zoning ordinance, building code, land use, environmental and other similar permits or approvals, all of which are in full force and effect as of the date hereof and none of which is subject to any revocation, amendment, release, suspension or forfeiture, (b) the present and contemplated use and/or occupancy of the Premises does not conflict with or violate any of the items delineated in clauses (i) and (ii) immediately above and (c) Mortgagor, promptly upon request by Mortgagee, shall deliver to Mortgagee copies of all of the same.
