Common use of Cessation of Work and Removal of Contractor's Equipment Clause in Contracts

Cessation of Work and Removal of Contractor's Equipment. After a notice of termination under sub-clause 15.5 [Employer's Entitlement to Termination], sub-clause 16.1 [Termination by Contractor] or sub-clause 19.5 [Force Majeure Affecting Subcontractor] has taken effect, the Contractor shall promptly: (a) cease all further work, except for such work as may have been instructed by the Engineer for the protection of life or property or for the safety of the Works; (b) hand over Contractor's Documents, Plant, Materials and other work, for which the Contractor has received payment; and (c) remove all other Goods from the Site, except as necessary for safety, and leave the Site.

After a notice of termination under subSub-clause 15.5 Clause 20 [Employer's Entitlement to Termination], subSub-clause 16.1 Clause 21.2 [Termination by Contractor] or subSub-clause 19.5 Clause 24.6 [Force Majeure Affecting SubcontractorOptional Termination, Payment and Release] has taken effect, the Contractor shall promptly: (a) cease all further work, except for such work as may have been instructed by the Engineer Employer/s for the protection of life or property or for the safety of the Works;, (b) if applicable, hand over Contractor's ’s Documents, Plant/s, Materials and other work, for which the Contractor has received payment; and, with due cognisance that the equipment and in question belongs to the Contractor; (c) remove all other Goods from the Site/s, except as necessary for safety, and leave the Site./s.
