Common use of CHANGE IN ADMINISTERING AUTHORITY Clause in Contracts

CHANGE IN ADMINISTERING AUTHORITY. 27.1 This clause 27 applies if any of the Councils is abolished or ceases to be an administering authority in circumstances where one or more local authorities become the administering authority in place of the Council. 27.2 Where this clause applies, the Council affected and the remaining Councils shall, subject to any contrary provision in any statutory order made in connection with the abolition or change in administering authority, make such arrangements as are necessary to enable the Council affected to withdraw from this Agreement and, where relevant, to be replaced as a party to this Agreement by the replacement administering authority or authorities, provided that the replacement administering authority or authorities so consent. 27.3 For the avoidance of doubt, where an affected Council withdraws from this Agreement in the circumstances set out in this clause 27, such withdrawal shall be deemed not to be a withdrawal for the purposes of clause 12. This Agreement is executed as a deed and delivered on the date stated at the beginning of this Agreement.
