Common use of Change in NERC Clause in Contracts

Change in NERC. This Agreement is premised on the existence of NERC, and the applicability of NERC definitions, policies, and procedures. To the extent that NERC ceases to exist in its current form, and/or is replaced with an entity with authority for reliability over the transmission systems of the Parties, the Parties shall promptly meet to determine whether to revise this Agreement to reflect the new reliability entity and the Parties’ obligations in light of the authority of the new reliability entity or to terminate this Agreement.
