Changes to Charges. We may adjust Our Charges provided that We may do so no more frequently than quarterly and: a) Our Variable Charge shall never be more than twenty five percent (25%) above cost generated by the Heat Trust’s Heat Cost Calculator (xxxx://xxxxxxxxx.xxx/index.php/test-the- xxxxxxxxx), as formulated June 2017; and b) if the Heat Trust’s Cost Calculator ceases to be published or is modified such that We reasonably believe that it is no longer an appropriate reference point, We may (acting reasonably) choose an alternative reference or index to replace it for the purpose of this provision. Our Standing Charge and all other charges above shall increase annually by a percentage equal to the increase (if any) in the CPI over the previous 12 (twelve) months.
Changes to ChargesFrom time to time, IBM may change its charges. Customer receives the benefit of a decrease in charges for amounts that become due on or after the effective date of the decrease. Unless provided otherwise in an Attachment or Transaction Document, IBM may increase recurring charges for Products and Services, as well as labor rates and minimums for Services provided under this Agreement, by giving Customer three months' written notice. An increase applies on the first day of the invoice or charging period on or after the effective date IBM specifies in the notice. IBM may increase one-time charges without notice. However, an increase to one-time charges does not apply to Customer if i) IBM receives the order before the announcement date of the increase and ii) one of the following occurs within three months after IBM’s receipt of the order: a. IBM ships Customer the Machine or makes the Program available to Customer; b. Customer makes an authorized copy of a Program or distributes a chargeable component of a Program to another Machine; or c. a Program's increased use charge becomes due. Upon reasonable notice, IBM may verify the usage data and other information affecting the calculation of charges under this Agreement. Such verification will be conducted in a manner that minimizes disruption to Customer’s business and may be conducted on Customer’s premises, during Customer’s normal business hours. Customer agrees to i) provide records, system tools outputs, and other electronic or hard copy system information reasonably necessary for such verification, and ii) promptly pay any additional, valid charges and other liabilities determined as a result of such verification.
Changes to Charges. If you have selected a Variable Rate product we may vary your electricity rates at any time during the term of the Market Contract by giving you notice of this change in accordance with applicable regulatory instruments. If there is a change that goes to the nature or structure of a tariff or charge for a nominated premises located in Victoria, you acknowledge that you have given explicit informed consent to the change to that tariff or charge for the Victorian premises.
Changes to Charges a) We may change your Charges if: i. information used to set the Charges set out in your Details is incorrect (e.g. the address of your Premises or your meter type); ii. a new meter type is installed at your Premises; or iii. your Distributor changes the network tariff for your Premises. b) We may also change your Charges, or apply a new Charge, for any reason.
Changes to ChargesWe may change our fees and charges, including by introducing a new type of fee or charge, to take account of any of the factors listed above at clause 5. 1. Where We make a change to comply with a legal or regulatory requirement, the change will be a fair proportion of the cost of compliance on our business, as reasonably estimated by us. Other changes will respond proportion- ately to changes in our costs. We will not change our charges to cover the same cost twice. In addition to the factors listed above at clause 5.1, We may also change the fees and charges applicable to your Account for reasons which are personal to You. These reasons may be based on a number of factors such as your personal credit risk profile, whether You keep to the terms of this Agreement and the way in which You use the Card and your Account.
Changes to Charges. (a) We may vary the Charges if: (i) We continue to provide the Service after the end of any Minimum Period, unless otherwise stated in the applicable Service Order Form; or (ii) You have requested a change to the Service to be provided and We have agreed in writing to that change. (b) We may vary the Charges at any time if there is an increase in the amount that We must pay to any other network operator or any of our suppliers in providing the Service to You.

Changes to Charges. 4.5.1. SWDconnect shall be entitled to increase any of the amounts reflected in the Subscriber agreement, which increase will be relative to the Consumer Price Index. Increases linked to the Consumer Price Index usually are done once per year between January and April. 4.5.2. If there is a price increase on components of the Services beyond the control of SWDconnect (for example: foreign exchange fluctuations, increased pricing on thirdparty products or services like software license fees, surcharges, taxes, import duties, rates or levies, increased charges from other network operators or delay caused by any instruction of Customer), then SWDconnect shall be entitled to increase the Charges of the affected Service in proportion to the increase in cost. 4.5.3. Any increase as per clause 4.5.1 and 4.5.2 will be given to the Customer in writing. 4.5.4. A Consumer will have the right to terminate the Contract without penalty or charge where any such increases render the Service unaffordable to the Consumer, on condition that it gives SWDconnect 20 (twenty) Business daysnotice of its election to cancel the Contract. Where a Consumer terminates the Contract as per its rights under this clause 4.5.4 such termination will be without penalty, except where the Consumer has been given or has purchased but not yet paid for Subscriber Equipment. In such a case the Consumer will have a legal duty, and SWDconnect will have a legal right to demand from the Consumer full payment in respect of the Subscriber Equipment less any amounts that have already been paid to SWDconnect in respect thereof before such termination.
