Common use of Changes to scheduling Clause in Contracts

Changes to scheduling. (a) Subject to clause 7.4(d), the Service Provider may by notice in writing to the Customer notify the Customer of any reasonably required changes to the scheduling procedures set out in this clause 7. (b) Within 5 Business Days of receiving the notice issued under clause 7.4(a), or such other period agreed between the parties, the Customer may provide any feedback that it may have on the proposed changes, and the Service Provider will consider (acting reasonably) any feedback the Customer may have before issuing a further notice setting out the changes to the scheduling procedures set out in this clause 7. (c) The changes detailed in the further notice issued pursuant to clause 7.4(b) (as amended pursuant to clause 7.4(b) as applicable) will take effect on and from the date specified in the further notice issued pursuant to clause 7.4(b), such date not to be less than 7 Days from the date the further notice was issued pursuant to clause 7.4(b). (d) Notwithstanding anything in this clause 7.4, clauses 7.4(b) and 7.4(c) do not apply if the Service Provider is required to make changes to the scheduling procedures set out in this clause 7 in order for the Service Provider, the Customer or both to comply with any Applicable Law.

(b) Within 5 Business Days of receiving the notice issued under clause 7.4(a), or such other period agreed between the parties, the Customer Shipper may provide any feedback that it may have on the proposed changes, and the Service Provider Transporter will consider (acting reasonably) any feedback the Customer Shipper may have before issuing a further notice setting out the changes to the scheduling procedures set out in this clause 7. (c) The changes detailed in the further notice issued pursuant to clause 7.4(b) (as amended pursuant to clause 7.4(b) as applicable) will take effect on and from the date specified in the further notice issued pursuant to clause 7.4(b), such date not to be less than 7 Days from the date the further notice was issued pursuant to clause 7.4(b). (d) Notwithstanding anything in this clause 7.4, clauses 7.4(b) and 7.4(c) do not apply if the Service Provider Transporter is required to make changes to the scheduling procedures set out in this clause 7 in order for the Service ProviderTransporter, the Customer Shipper or both to comply with any Applicable Law.
