Common use of City Right to Continue Lease Clause in Contracts

City Right to Continue Lease. In the event of any default under this Lease by the Tenant (and regardless of whether or not the Tenant has abandoned the Premises), this Lease will not terminate (except by an exercise of the City’s right to terminate under this Section 12.3) unless the City makes such election by the giving of any notice (including, without limitation, any notice preliminary or prerequisite to the bringing of legal proceedings in unlawful detainer) to terminate the Tenant’s right to possession. For so long as this Lease continues in effect, the City may enforce all of the City’s rights and remedies under this Lease, including, without limitation, the right to recover all rent and other monetary payments as they become due hereunder. For the purposes of this Lease, the following shall not constitute termination of the Tenant’s right to possession: (a) acts of maintenance or preservation or efforts to relet the Premises; or (b) the appointment of a receiver upon initiative of the City to protect the City’s interest under this Lease.
