Claimant’s Rights Clause Samples
Claimant’s Rights. If a Claim is wholly or partially denied under Section 11.7, then the Claimant or his duly authorized representative shall have the following rights, within 60 days of the date on which he receives the notice:
(1) to obtain, subject to (b) below, a full and fair review by the Committee;
(2) to review pertinent documents; and
(3) to submit issues and comments in writing.
Claimant’s Rights. If a Claim is wholly or partially denied under Section 11.5, then the Claimant or his duly authorized representative shall have the following rights:
(1) to obtain, subject to (b) below, a full and fair review by the Administrator;
(2) to review pertinent documents; and
(3) to submit issues and comments in writing.
