Class Action Fairness Act Notice. 5.1 Defendant will be responsible for serving the Class Action Fairness Act (“CAFA”) notice required by 28 U.S.C. § 1715 within ten days after Plaintiff files the motion to preliminarily approve the Settlement. 5.2 Defendant will provide Class Counsel with a copy of the CAFA notice no later than two days after it is served. 5.3 Defendant will also file with the Court, at least 30 days prior to the Fairness Hearing, a notice attesting to its compliance with CAFA.
