Common use of Clean Water and Air Requirements Clause in Contracts

Clean Water and Air Requirements. A. The Contractor agrees to comply with all applicable standards, orders or regulations issued pursuant to the Federal Water Pollution Control Act, 33 U.S.C. Sections 1251 et seq., and the Clean Air Act, 42 U.S.C. Sections 7401 et seq. The Contractor agrees to report each violation to the Department and understands and agrees that the Department will, in turn, report each violation as required to assure notification to FTA and the appropriate United States Environmental Protection Agency Regional Office. B. The Contractor agrees to include these requirements in each contract or subcontract exceeding $100,000.00 and financed in whole or in part with federal assistance provided by the FTA.
