Common use of COD Delays Clause in Contracts

COD Delays. If the Commercial Operations Date for a Unit does not occur prior to 1000 Central Time on the Target COD and if Seller fails to deliver or cause to be delivered Replacement Power or Substitute Power in accordance with Section 4.7.3 or to agree to Buyer's Delay Book Out Charge as described in Section 3.3.2, Seller shall be liable to Buyer for Delay LDs per Unit per day for the period of the delay.
