Collection and appropriation of Fee. 27.1.1 On and from the COD of Phase- I till the Transfer Date, the Concessionaire shall have the sole and exclusive right to demand, collect and appropriate Fee from the Patients either directly or from the Insurers/Government Instrumentality, as applicable under the Government Health Scheme and/or the Authority in accordance with this Agreement. 27.1.2 The Concessionaire acknowledges and agrees that upon payment of Fee, any Patient shall be entitled to use the Hospital and the Concessionaire shall not place, or cause to be placed, any restriction on such use, except to the extent specified in any Applicable Law, Applicable Permit or the provisions of this Agreement. 27.1.3 Except as expressly provided under this Agreement, the Concessionaire acknowledges and undertakes that the Fee for the Inpatients shall be determined in the following manner: (a) in respect of Select Patients enrolled under any Government Health Scheme, the Concessionaire shall be entitled to determine, demand and collect the Fee for the Select Patients admitted in the Hospital from the Insurer or the concerned Governmental Instrumentality, as the case may be, at the rates applicable under and in accordance with the relevant Government Health Scheme (depending on the enrolment of the Select Patient under the relevant Government Health Scheme) applicable in non-NABH accredited hospitals/ health centres in the district where the Hospital is located, for such period. Provided however, on and from the date of accreditation of the Hospital under the Accreditation Standard, the Fee for Select Patients admitted in the Hospital shall not be more than the rates applicable under the relevant Government Health Scheme in similarly accredited hospitals/ health centres in the district where the Hospital is located. (b) in respect of Non- Government Scheme Select Patients, the Fee for such Healthcare Services provided to such Select Patients shall not be higher than the BSKY rates applicable in hospitals in the district where the Hospital is located with accreditation similar to the Accreditation Standard under which the Hospital is accredited. In the event the BSKY rates applicable in such similarly accredited hospitals in the district where the Hospital is located do not include any such Healthcare Services, the Concessionaire shall be entitled to determine Fee for such Healthcare Services in the manner it deems fit not exceeding the Fee it charges to Patients other than the Select Patients. (c) in respect of Inpatients (other than those specified in sub-clauses (a) and (b) above) the Concessionaire shall be free to determine, demand and collect 27.1.4 Except as expressly provided under this Agreement, the Concessionaire acknowledges and undertakes that the Fee for the Outpatients shall be determined in the following manner: (a) the Concessionaire shall be free to determine, demand and collect the Fee for the OPD Services in the Hospital from any Outpatient including a Select Patient availing Outpatient Services; and (b) the Concessionaire shall be free to determine, demand and collect the Fee, for Diagnostic Services from any Patient including a Select Patient. 27.1.5 The Concessionaire hereby agrees that the Fee for Select Patients determined in accordance with this Clause 27.1 shall also include Consumables which are included under the extant package rates under the applicable Government Health Schemes. The Parties further agree that in the event any Consumables are not covered under the extant package rates, the Concessionaire shall collect the Fee separately for such Consumables in accordance with market rates.

Provided however, on and from the date of accreditation of if the Hospital is required to obtain accreditation under the Accreditation Standard, the Fee for Select Patients admitted in the Hospital shall not be more than the rates applicable under the relevant Government Health Scheme in similarly accredited hospitals/ health centres in the district where the Hospital is located, on and from the date of the accreditation of the Hospital under the relevant Accreditation Standard. (b) in respect of Non- Government Scheme Select Patients, the Fee for such Healthcare Services provided to such Select Patients shall not be higher than the NHPS rates / BSKY rates (as applicable) applicable in hospitals in the district where the Hospital is located with accreditation similar to the Accreditation Standard under which the Hospital is accredited. In the event the NHPS rates/ BSKY rates (as applicable) applicable in such similarly accredited hospitals in the district where the Hospital is located do not include any such Healthcare Services, the Concessionaire shall be entitled to determine Fee for such Healthcare Services in the manner it deems fit not exceeding the Fee it charges to Patients other than the Select Patients. Provided however, at if a Facility is not accredited with NABHduring any period after the rates applicable under and in accordance with the relevant Government Health Scheme (depending on the enrolment expiry of the aforesaid 3 (three) years, the Fee for Select Patient under Inpatients admitted in such Facility shall not be more than the relevant Government Health SchemeOSTF rates or RSBY rates (as the case may be) applicable in non-NABH accredited hospitals/ health centres in the district where the Hospital is located, Bhubaneswar for such period. Provided however, on and from the date of accreditation of the Hospital under the Accreditation Standard, the Fee for Select Patients admitted in the Hospital shall not be more than the rates applicable under the relevant Government Health Scheme in similarly accredited hospitals/ health centres in the district where the Hospital is located.; and (b) in respect of Non- Government Scheme Select Patients, the Fee for such Healthcare Services provided to such Select Patients shall not be higher than the BSKY rates applicable in hospitals in the district where the Hospital is located with accreditation similar to the Accreditation Standard under which the Hospital is accredited. In the event the BSKY rates applicable in such similarly accredited hospitals in the district where the Hospital is located do not include any such Healthcare Services, the Concessionaire shall be entitled to determine Fee for such Healthcare Services in the manner it deems fit not exceeding the Fee it charges to Patients other than the Select Patients. (c) in respect of Inpatients (other than those specified in sub-clauses (a) and (b) above) the Concessionaire shall be free to determine, demand and collectcollect the Fee for any other Inpatient admitted in the Healthcare Network. 27.1.4 Except as expressly provided under this Agreement, the 31.1.4 The Concessionaire acknowledges and undertakes that the Fee for the Outpatients shall be determined in the following manner: (a) the Fee for the Select Outpatients for the OPD Diagnostic Services and OPD Procedures in the Health Centres between 0800 hours to 1400 hours (“Discounted Hours”) shall not be more than the Discounted Outpatient Fee. The Select Outpatients shall be entitled for free OPD Consultations during the Discounted Hours; (b) the Concessionaire shall be free to determine, demand and collect the Fee for the OPD Services in the Health Centres availed beyond the Discounted Hours by Select Outpatients; (c) Concessionaire shall be free to determine, demand and collect the Fee for the OPD Services (with the exception of OPD Consultations during the Discounted Hours) in the Health Centres from any other Outpatient. It is clarified that the Outpatients shall be entitled for free OPD Consultations during the Discounted Hours; (d) the Fee for the Select Outpatients for the OPD Services in the Hospital shall not be more then Discounted Outpatient Fee; and (e) Concessionaire shall be free to determine, demand and collect the Fee for the OPD Services in the Hospital from any Outpatient including a Select Patient availing Outpatient Services; and (b) the Concessionaire shall be free to determine, demand and collect the Fee, for Diagnostic Services from any Patient including a Select Patientother Outpatient. 27.1.5 The Concessionaire hereby agrees that the Fee for Select Patients determined in accordance with this Clause 27.1 shall also include Consumables which are included under the extant package rates under the applicable Government Health Schemes.
