Common use of Collection and Use of Information Clause in Contracts

Collection and Use of Information. 9.1. Licensee acknowledges that Licensor may, directly or indirectly through the services of Third Parties, collect and store information regarding use of the Software and about equipment on which the Software is installed or through which it otherwise is accessed and used, through the provision of maintenance and support services. 9.2. Licensee agrees that the Licensor may use such information for any purpose related to any use of the Software by Licensee or on Licensee's equipment, including but not limited to:‌ (a) improving the performance of the Software or developing upgrades; and (b) verifying Licensee's compliance with the terms of this Agreement and enforcing the Licensor's rights, including all Intellectual Property Rights in and to the Software.

Licensee acknowledges that (a) Licensor may, directly or indirectly through the services of Third Partiesothers, collect and store information regarding use of the Software and about equipment on which the Software is installed or through which it otherwise is accessed and used, through the provision by means of (i) providing maintenance and support servicesservices and (ii) security measures included in the Software as described in Section 3. 9.2. Licensee agrees (b) You agree that the Licensor may use such information for any purpose related to any use of the Software by Licensee or on Licensee's equipmentyou, including but not limited to:‌ to: (ai) improving the performance of the Software or developing upgradesupdates; and (b) and verifying Licensee's compliance with the terms of this Agreement and enforcing the Licensor's rights, including all Intellectual Property Rights intellectual property rights in and to the Software.

(b) Licensee agrees that the Licensor may use such information for any purpose related to any use of the Software by Licensee or on Licensee's equipment, including but not limited to:‌ (a) to improving the performance of the Software or developing upgradesUpdates; and (b) and verifying Licensee's compliance with the terms of this Agreement and enforcing the Licensor's rights, including all Intellectual Property Rights in and to the Software.

Licensee agrees that the Licensor may use such information for any purpose related to any use of the Software by Licensee or on Licensee's ’s equipment, including but not limited to:‌ to: (ai) improving the performance of the Software or developing upgradesUpdates; and and (bii) verifying Licensee's ’s compliance with the terms of this Agreement and enforcing the Licensor's ’s rights, including all Intellectual Property Rights in intellectual property rights in, to, and to under the Licensed Software.
