Common use of Collection and Use of Information Clause in Contracts

Collection and Use of Information. When you participate, we collect basic information about how you use the Product and your computer. We also collect information about how each is set up and performing. These reports are sent to ABB to help improve the features our customers use most often and to create solutions to common problems. For Automation Builder Standard or Premium users, you can choose to participate in the User Experience Report by clicking the options menu in the Automation Builder program and then click Customer Feedback Options. For Automation Builder Basic users and for users with a 30days trial license, it is mandatory to participate in the Usability Improvement Program. Automation Builder is downloadable from Internet. Automation Builder Basic and the 30 days trial license are free to use. The Usability Improvement Program report generally includes information about: Configuration, such as how many processors in your computer, how many network connections you use, the operating system that your computer is currently running and the screen resolutions for display devices. Performance, such as how quickly Automation Builder responds and how many problems you experience with the Automation Builder program. Program use, such as the features that you use the most often and how frequently you launch programs. Internet-enabled features in ABB software will send information about your computer to ABB. This information is generally not personally identifiable. This information typically includes certain information about your computer software and hardware, such as your IP address, operating system version, your hardware ID (which indicates the device manufacturer, device name, and version), and your regional and language settings. Although when each Usability Improvement Program Report is sent to ABB, this information is sent as well. Usability Improvement Program Reports do not intentionally contain any contact information about you (such as your name, address, or phone number). However, some reports might unintentionally contain individual identifiers, such as a serial number for a device that is connected to your computer. ABB filters the information contained in Usability Improvement Program Reports to try to remove any individual identifiers that they might contain. ABB uses Usability Improvement Program Reports information to improve our software. We may share Usability Improvement Program Report information with partners, but the information cannot be used to identify you. Information that is collected by or sent to ABB may be stored and processed in Germany or any other country in which ABB or its affiliates, subsidiaries, or agents maintain facilities. ABB may disclose this information if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on ABB or the site; (b) protect and defend the rights or property of ABB, or (c) act in urgent circumstances to protect the personal safety of ABB employees, users of ABB software or services, or members of the public. ABB occasionally hires other companies to provide limited services on its behalf, such as providing customer support, processing transactions, or performing statistical analysis of reports. ABB will provide those companies only the information they need to deliver the service. They are required to maintain the confidentiality of this information and are prohibited from using it for any other purpose.
