Common use of COMI Clause in Contracts

COMI. The “centre of main interests” (within the meaning of the EC Insolvency Regulation) of the Borrower or 00xx Xxxxxx is at any time not in Luxembourg; or

COMI. The “centre of main interests” (within the meaning of the EC Insolvency Regulation) of the European Borrower or 00xx Xxxxxx 54th Street is at any time not in Luxembourg; or
