Commencement Date; Term. Employment of Executive shall continue on the terms herein from and after the date first set forth above (the “Commencement Date”), and shall continue during the period ending on December 31, 2027, unless terminated prior to such date pursuant to Section 7. Following December 31, 2027, the term of the Agreement shall be extended for an additional year, on each anniversary of the Commencement Date, unless either party gives 180 days prior written notice that the term will not be extended (the “Employment Term”). The Employment Term shall terminate upon any termination of Executive’s employment pursuant to Section 7.
Commencement Date; Term. The Expansion Space D Commencement Date (“ESDCD”) shall mean the date which is one hundred fifty (150) days after the date on which Landlord delivers possession of Expansion Space D to Tenant for occupancy (which delivery is estimated to be January 1, 2019) and, upon the ESDCD (which is estimated to be June 1, 2019), Expansion Space D becomes a part of the Premises, and Tenant’s obligation to pay rent commences with respect to Expansion Space D. The Term of this lease of Expansion Space D (the “Space D Term”) shall continue until the Phase 1 Termination Date. Within thirty (30) days after request by Landlord, Tenant and Landlord shall enter into an agreement confirming the ESDCD and the Monthly Base Rent substantially in the form of Exhibit B attached hereto. If Tenant fails to enter into such agreement within ten (10) days following Landlord’s delivery of written notice of such failure to Tenant, then the ESDCD shall be the date designated by Landlord in such agreement.
Commencement Date; Term. This Lease shall have a ten (10) year term (“Term”). The Lease Term begins (the “Commencement Date”) on February 1, 2019 and terminates on January 31, 2029 (the “Termination Date”).

Notwithstanding the foregoing, if Notice to Proceed for Services has been issued by Thornton to Service Provider and the Services will not be completed as of the Agreement termination date, and if Thornton desires Service Provider to complete the Services, the terms and conditions of this Agreement shall survive the termination date of the Agreement and continue until the Services is/are completed to Xxxxxxxx’x satisfaction.

Should this Agreement terminate on the date listed above and Xxxxxxxx has not found a suitable replacement of services from another Vendor, Xxxxxxxx may request in writing that the Vendor continue the Service(s) on a month-to-month prorated basis for a continued use of the software, until a formal written notice of termination has been provided by Xxxxxxxx.

Following December 31, 2020, the term of the Agreement shall be extended for an additional year, on each anniversary of the Commencement Date, unless either party gives 180 days prior written notice that the term will not be extended (the “Employment Term”). The Employment Term shall terminate upon any termination of the Executive’s employment pursuant to Section 6 hereof. For the avoidance of doubt, prior to the Commencement Date the Prior Employment Agreement shall remain in full force and effect and continue to govern the rights and obligations of the Executive and the Company.
Commencement Date; Term. The Premises are leased for a term (the “Term”) to commence on the “Commencement Date” (as defined in Section 3.2) and shall end on the date (the “Expiration Date”) that is the last day of the thirty-sixth (36th) full calendar month following the “Rent Commencement Date” (as defined in Section 4.1 below) unless sooner terminated as herein provided. Subject to operation of Article 3 below, the Term comprises thirty-nine (39) full calendar months plus any partial monthly period (if the Commencement Date does not occur on the first day of a calendar month).

Landlord hereby leases the Premises to Tenant and Tenant hereby leases the Premises from Landlord pursuant to this Lease for a term (the “Term”) to commence on the date (the “Commencement Date”) of execution and delivery of this Lease by both Landlord and Tenant. The Term shall end on the last day of the tenth (10th) Lease Year (the “Expiration Date”), unless sooner terminated as herein provided.
