Commitment of maintaining Qualification Requirement. 19.2.1 The Selected Bidder will be required to continue to maintain compliance with the Qualification Requirements, as stipulated in RFP Document, till the COD of the Project. Where the Technically Evaluated Entity and/or the Financially Evaluated Entity is not the Bidding Company or a Member in a Bidding Consortium, as the case may be, the Bidding Company or Member shall continue to be an Affiliate of the Technically Evaluated Entity and/or Financially Evaluated Entity till the COD of the Project. 19.2.2 Failure to comply with the aforesaid provisions shall be dealt in the same manner as TSP’s Event of Default as under Article 13 of this Agreement.
