A. GRID USER DECLARATION ▇▇▇▇ must receive the proof that the Grid User has signed without reserves the Grid User Declaration containing the following clauses:  “The Grid User Concerned hereby gives the BSP the permission to offer the Tertiary Control Power Service to ▇▇▇▇ as described in the General Framework Agreement for Tertiary Control Power by non-CIPU Units (hereinafter, “General Framework Agreement”) concluded between the BSP and ▇▇▇▇, from to .  “The Grid User Concerned hereby acknowledges that all given information in this Grid User Declaration is true and accurate.”  “The Grid User Concerned hereby acknowledges submitting this information for one BSP and that he will participate in the Tertiary Control Power by non-CIPU Technical Units service with only one BSP at the same time.”  “The Grid User Concerned hereby renounces any possible legal claims that he might invoke against ▇▇▇▇ because of the implementation of the General Framework Agreement for Tertiary Control Power. The Grid User Concerned moreover confirms to ▇▇▇▇ that his commitment to provide Tertiary Reserve Power as stipulated in this General Framework Agreement for Tertiary Control by non-CIPU Technical Units does not breach existing contracts with third parties (with whom the Grid User has a contractual or regulated relationship, such as, but not limited to, the energy BSP of the Grid User Concerned).”  The Grid User Concerned acknowledges that the present document is valid until either its respective expiry date or the submission by another BSP of a new Grid User declaration for the Delivery Point Concerned signed and validated by the Grid User Concerned.  “The Grid User Concerned hereby gives explicit permission to ▇▇▇▇ to inform the BSP of the measurements of the Delivery Points Concerned.”  “Details of the Delivery Point Concerned:” Deliver Point Name Delivery Point Identification (EAN) DPR3,max [MW...
COMMUNICATION TESTS. The Provider and ▇▇▇▇ will check together before the start of delivery if following conditions are met: • The Provider must be able to receive and interpret the signals as defined in Annex 6. • A secure and redundant communication channel is set up between ▇▇▇▇ and the Provider. ▇▇▇▇ may demand to heighten this communication security and redundancy for reasons of grid security. • The Provider can contact ▇▇▇▇ to request a communication test at any moment also proposing a time and date within at earliest 5 working days following his request. At the moment of the request implementation of the Provider must already be accomplished. • In case that the organization requirements are not fulfilled at any time during validity of the General Framework, ▇▇▇▇ and the Provider will make their best effort to identify the source of the failure and the Provider is expected to solve the source of the failure. The Provider will be suspended from bidding as specified in Article 3.7 for the time necessary for solving the source of the failure. • Any costs linked to the tests are borne by the Provider;

COMMUNICATION TESTS. Concurrent to the SAT, all communication equipment will be tested in the field. For this testing, all the communication equipment shall be fully operational for Commission personnel to operate.
COMMUNICATION TESTS. All communications subsystems' receivers shall be tested for sensitivity and interference rejection. The TDMA/QPSK Gateway modulation format shall be verified and the implementation loss measured for both the Gateway receiver and transmitter. The SDPSK-burst Subscriber Receiver acquire/communicate and reservation modes shall be tested to determine the implementation loss and degradation with frequency offset. The Subscriber transmitter shall be tested for SDPSK format and implementation loss. Test procedures shall be written for each of these communication system tests. ORBCOMM Global shall have the right to comment on these test plans and to monitor the tests. ORBCOMM Global shall have full access to the test data and test reports.
