Common use of Communications to be Given in Writing Clause in Contracts

Communications to be Given in Writing. Subject to any express provisions in this Agreement to the contrary, all instructions, decisions, opinions and other communications from the Supervising Officer and/or Authorised Officer (as the case may be) to the Contractor or the Operations Manager or from the Contractor or Operations Manager to the Supervising Officer and/or Authorised Officer which are intended to have a binding effect on the Contractor or the Councils (as the case may be) shall be in writing or, if given orally, shall be confirmed in writing no later than the next Business Day.
