COMPENSATION FOR NEW FACILITIES. Whenever a System Impact Study performed by the Transmission Provider in connection with the provision of Firm Point-to-Point Transmission Service identifies the need for new facilities, the Transmission Customer shall be responsible for costs of new facilities to the extent consistent with law and/or Board policy governing the Transmission Provider.
