Compensation to Engineer. A. City agrees to pay to Engineer for all services outlined in Section III, a base design fee in an amount not to exceed $59,600.00. The following services are not included in this base fee: 1. Services required by Section III.A., Additional Services, for which cost is set out in III.A. 2. Work necessary to perform the design field survey as described in III.B., Field Survey Work, for which cost is set out in II.B. 3. Work necessary for the preparation of right-of-way and/or easement acquisition data as described by Section III.F., Right-of-Way/Easement Determination, for which cost is set out in II.C. B. All costs associated with performing the design field survey as outlined in III.B. is included in the base design fee and shall be on an hourly basis as shown in Appendix "A". C. No right-of-way acquisition is anticipated with this project. However, should the City determine the need for this data, all costs associated with right-of-way acquisition data, as outlined in III.F., shall be paid to Engineer by City on an hourly fee basis as shown in Appendix "A" unless mutually agreed to in writing by the parties hereto. Appendix "A" is hereby incorporated within this contract as if written word for word. In no case shall more than seventy-five percent (75%) of this amount be paid until all right-of-way acquisition data is accepted by City. D. Direct expenses shall include subcontract charges for surveying, contract labor, computer time, printing, reproduction expense, communication expense, travel, transportation, and subsistence out of Tarrant and Dallas Counties directly related to the work. Direct costs are included in the base design fee and shall be actual cost multiplied by the factor of 1.1. Evidence of cost incurred for direct expenses shall be submitted with each billing. E. Written request for payment for services rendered by Engineer may be made on a monthly basis. City will pay to the Engineer as follows: 1. An amount not to exceed the amount set out in II.B. until satisfactory completion of the design survey as set forth herein. 2. An amount not to exceed forty percent (40%) of the total base design fee until satisfactory completion of the conceptual design plans. 3. An amount not to exceed eighty-five percent (85%) of the total base design fee until satisfactory completion of the preliminary construction plans and right-of- way documents. 4. An amount not to exceed ninety-five percent (95%) of the total base design fee until satisfactory completion of the final construction plans and specifications, and right-of-way documents. 5. An amount equal to five percent (5%) shall be retained until such time as City requests and receives one (1) set of reproducibles of the final design construction plans and other documents described herein. 6. No interest shall accrue for late payments. CITY shall not be required to pay any amount in excess of the original amount unless CITY shall have approved in writing in advance (prior to the performance of additional work) the payment of additional amounts. If at any time it becomes evident that the cost estimates provided to CITY will not be sufficient to complete the authorized work, Engineer will immediately notify CITY in writing of said fact.

F. Written request for payment for services rendered by Engineer may be made on a monthly basis. City will pay to the Engineer as follows: 1. An amount not to exceed the amount set out in II.B. II.B until satisfactory completion of the design survey as set forth herein. 2. An amount not to exceed forty sixty-five percent (4065%) of the total base design fee until satisfactory completion of the conceptual design plans. 3. An amount not to exceed eighty-five percent (85%) of the total base design fee until satisfactory completion of the preliminary construction plans and right-of- of-way documents. 43. An amount not to exceed ninety-five thirty percent (9530%) of the total base design fee until satisfactory completion of the final construction plans and specifications, and right-of-way documents. 54. An amount equal to five percent (5%) shall be retained until such time as City requests and receives one (1) set of reproducibles of the final design construction plans and other documents described herein. 6. C. No right-of-way acquisition is anticipated with this project. However, should the City determine the need for this data, all All extra costs associated with right-of-way acquisition data, as outlined in III.F., shall be paid to Engineer by City on an hourly fee basis as shown in Appendix "A" Exhibit “B” in an amount not to exceed $ 14,850 unless mutually agreed to in writing by the parties hereto. Appendix "A" Approximately 30 easement documents are expected at a rate of $495/easement document. Exhibit “B” is hereby incorporated within this contract as if written word for word. In no case shall more than seventy-five percent (75%) of this amount be paid until all right-of-way acquisition data is accepted by City. D. . All direct costs associated with right-of-way acquisition data shall be paid to Engineer by City on the basis of direct expenses times a multiplier of l.l. Direct expenses shall include subcontract charges for surveying, contract labor, computer time, printing, reproduction expense, communication expense, travel, transportation, and subsistence out of Tarrant and Dallas Counties directly related to the work. Direct costs are included shall not exceed the rates indicated in the base design fee Exhibit “C.” Exhibit “C” is hereby incorporated within this contract as if written word for word and shall be actual cost contain the result of the rates for direct costs multiplied by the factor of 1.1. Evidence of cost incurred for direct expenses shall be submitted with each billing. D. All costs associated with design of water and sanitary sewer improvements, as outlined in III.G., shall be paid to Engineer by City on an hourly fee basis as shown on Exhibit “C” in an amount not to exceed $ 29,815. E. Written request for payment Payment for services rendered by Engineer may will be made on a monthly basis. City will pay to the Engineer as follows: 1. An amount not to exceed the amount set out in II.B. until Upon satisfactory completion of the design survey as set forth herein., and upon written request, City shall pay to Engineer the amount set out in II.B. 2. Once the City has accepted the final design construction plans and specifications as set forth herein, and upon written request, City shall pay to Engineer an amount equal to fifteen percent (15%) of the base design fee as set forth herein. 6. An amount equal to five percent (5%) shall be retained until such time as City requests and receives one (1) set of reproducibles of the final design construction plans and other documents described herein. This request shall be made within 120 days of the acceptance of final design construction plans. 67. For the work described in Section III.A., Section III.F., and Section III.G., City shall pay Engineer on an hourly basis at the rates shown on Exhibits “B” and “C” subject to provisions set forth herein. Invoices may be presented on a monthly basis. 8. No interest shall accrue for late will be due on any payments. CITY shall not be required to pay any amount in excess of the original amount unless CITY shall have approved in writing in advance (prior to the performance of additional work) the payment of additional amounts. B. City agrees to pay to Engineer on an hourly fee basis for the following Additional Services: 1. Services required Engineer shall prepare plans and/or paperwork necessary to obtain any permits re- quired by Section III.A.franchised utilities, Additional Servicespipeline companies, railroad companies, TxDOT, or any other entity requiring permits relative to construction of Project (total fee for which cost is set out in III.A.this service not to exceed $33,000.00). 2. Work necessary Engineer shall provide construction service at the request of the City. Such service may include, but not limited to perform field visits, change orders, plan revisions, etc. Engineer shall bill the design field survey as described in III.B., Field Survey Work, City based on actual hours performed and associated direct cost (total fee for which cost is set out in II.B.this service not to exceed $44,725.00). 3. Work necessary for the preparation of right-of-way and/or easement acquisition data as described by Section III.F., Right-of-Way/Easement Determination, for which cost is set out in II.C. B. C. All costs associated with performing the design field survey as outlined in III.B. is included in the base design fee and shall be on paid to Engineer by City in an hourly basis as shown in Appendix "A"amount not to exceed $83,430.00. C. No right-of-way acquisition is anticipated with this project. However, should the City determine the need for this data, all D. II.B until satisfactory completion of the design survey as set forth herein. 2. An amount not to exceed forty percent (40%) of the total base design fee until satisfactory completion of the conceptual design plans. 3. An amount not to exceed eighty-five thirty percent (8530%) of the total base design fee until satisfactory completion of the preliminary construction plans and right-of- of-way documents. 4. II.B until satisfactory completion of the design survey as set forth herein. 2. An amount not to exceed eightyforty-five percent (8545%) of the total base design fee until satisfactory completion of the preliminary construction plans and right-of- of-way documents. 4. An amount not to exceed ninety-five ten percent (9510%) of the total base design fee until satisfactory completion of the final construction plans and specifications, and right-of-way documents. 5. An amount equal to five percent (5%) shall be retained until such time as City requests and receives one (1) set of reproducibles of the final design construction plans and other documents described herein. 6. No interest shall accrue for late will be due on any payments. C. No right-of-way acquisition is anticipated with this project. However, should the City determine the need for this data, all All costs associated with right-of-way and/or easement acquisition data, such as outlined in III.F.Utility Easements and “corner clips”, shall be paid to Engineer by City on an hourly fee basis as shown in Appendix Attachment "A" at the rate of $1,000.00 per description, in an amount not to exceed $5,000.00 unless mutually agreed to in writing by the parties hereto. An amount equal to five percent (5%) shall be retained until such time as City requests and receives one (1) set of reproducibles of the final design construction plans and other documents described herein. This request shall be made within 120 days of the acceptance of final design construction plans. 67. For the work described in Section III.A., Section III.F., and Section III.G., City shall pay Engineer on an hourly basis at the rates shown on Attachment "A" and "B" subject to provisions set forth herein. Engineer shall provide construction service at the preparation request of right-of-way and/or easement acquisition data as described by Section III.F.the City. Such service may include, Right-of-Way/Easement Determinationbut not limited to field visits, for which change orders, plan revisions, etc. Engineer shall xxxx the City based on actual hours performed and associated direct cost is set out in II.C.(hourly fee not to exceed $10,200.00). Work Engineer shall prepare plans and/or paperwork necessary to obtain any permits re- quired by franchised utilities, pipeline companies, railroad companies, TxDOT, or any other entity requiring permits relative to construction of Project (total fee for the preparation of right-of-way and/or easement acquisition data as described by Section III.F., Right-of-Way/Easement Determination, for which cost is set out in II.C.this service not to exceed $10,010.00). All costs associated with performing the design field survey as outlined in III.B. is included in the base design fee and shall be on paid to Engineer by City in an hourly basis as shown in Appendix "A"amount not to exceed $41,865.00. No interest shall accrue for late payments. CITY shall not be required to pay any amount in excess of the original amount unless CITY shall have approved in writing in advance (prior to the performance of additional work) the payment of additional amounts. Compensation to Engineer. A. City agrees to pay to Engineer for all services outlined in Section III, a base design fee in an amount not to exceed $59,600.00177,100.00. An amount not to exceed ninetythirty-five percent (9535%) of the total base design fee until satisfactory completion of the final construction plans and specifications, and right-of-way documents. 5. An amount equal to five percent (5%) shall be retained until such time as City requests and receives one (1) set of reproducibles of the final design construction plans and other documents described herein. 6. Work necessary Engineer will establish the scope of and arrange for the soil and foundation investigations (hourly fee not to perform the design field survey as described in III.B., Field Survey Work, for which cost is set out in II.B.exceed $13,000.00). 3. Work necessary for Engineer shall provide construction service at the preparation request of right-of-way and/or easement acquisition data as described by Section III.F.the City. Such service may include, Right-of-Way/Easement Determinationbut not limited to field visits, for which change orders, plan revisions, etc. Engineer shall xxxx the City based on actual hours performed and associated direct cost is set out in II.C.(hourly fee not to exceed $5,000.00). All costs associated with performing the design field survey as outlined in III.B. is included in the base design fee and shall be on paid to Engineer by City in an hourly basis as shown in Appendix "A"amount not to exceed $14,798.00. This request shall be made within 120 days of the acceptance of final design construction plans. 67. All costs associated with performing the design field survey as outlined in III.B. is included in the base design fee and shall be on paid to Engineer by City in an hourly basis as shown in Appendix "A"amount not to exceed $162,020.00. C. No right-of-way acquisition is anticipated with this project. However, should the City determine the need for this data, all D. An amount not to exceed forty percent (40%) of the total base design fee until satisfactory completion of the conceptual design plans. 3. An amount not to exceed eighty-five percent (85%) of the total base design fee until satisfactory completion of the preliminary construction plans and right-of- way documents. 4. An amount not to exceed ninety-five percent (95%) of the total base design fee until satisfactory completion of the final construction plans and specifications, and right-of-way documents. 5. An amount equal to five percent (5%) shall be retained until such time as City requests and receives one (1) set of reproducibles of the final design construction plans and other documents described herein. 6. No interest shall accrue for late payments. 3. CITY shall not be required to pay any amount in excess of the original amount unless CITY shall have approved in writing in advance (prior to the performance of additional work) the payment of additional amounts.
