The Workers' Compensation policy required hereunder shall be endorsed to state that the workers' compensation carrier waives its right of subrogation against the Sunrise Recreation and Parks District and the County of Sacramento, their governing Boards, officers, directors, officials, employees, and authorized volunteers and agents, which might arise by reason of payment under such policy in connection with performance under this Agreement by the Lessee.

Should Workers’ Compensation be required for per provisions of California Labor Code Section 3700 for license agreement, Licensee shall ensure the workers’ compensation policy required shall be endorsed to state that the workers’ compensation carrier waives its right of subrogation against the County, its officers, directors, officials, employees, agents or volunteers, which might arise by reason of payment under such policy in connection with performance under this License by the Licensee.
COMPENSATION WAIVER OF SUBROGATION. The COUNTY shall not be liable to CONTRACTOR or its employees for any injuries to CONTRACTOR’s employees arising out of the performance of work under this Contract. CONTRACTOR and its workers compensation insurance carrier agree to waive any and all rights of recovery from the COUNTY for workers compensation claims made by its employees. The CONTRACTOR agrees that the indemnification and hold harmless provisions within this Contract extend to any claims brought by or on behalf of any employee of the CONTRACTOR.

Should CONSULTANT be self-insured for workers' compensation, CONSULTANT hereby agrees to waive its right of subrogation against SACRAMENTO REGIONAL COUNTY SANITATION DISTRICT, SACRAMENTO AREA SEWER DISTRICT and the County of Sacramento and their officers, directors, officials, employees, agents or volunteers.

Should CONTRACTOR be self-insured for workers’ compensation, CONTRACTOR hereby agrees to waive its right of subrogation against COUNTY, its officers, directors, officials, employees, agents or volunteers.
