Compensatory Time/Overtime. At the time an employee is assigned to work in excess of 40 hours in any week, the employee and supervisor will come to a mutual agreement on whether the employee will receive overtime pay or compensatory time, with the final decision resting with the Superintendent. The specific date(s) of compensatory time used, will be determined by the employee, and must occur within 45 calendar days. No more than one employee from each job category may be out on compensatory time on a given day. If the compensatory time is not used within 45 days of when it is earned, it will be paid out to the employee.
Compensatory Time/Overtime. Full-time nurses shall be eligible to earn compensatory time, or overtime, at the nurse’s option under the following guidelines. Part-time nurses shall be eligible to earn excess time at the rate of time and one-half (1½) selected at the nurse's option under the following conditions:
9.14.1 Work in excess of forty (40) hours in any work week.
9.14.2 Work extending two or more hours beyond the nurse's regularly scheduled shift of eight hours or more in any work day. For work of less than two hours in excess of the regularly scheduled shift, nothing herein shall preclude the District from flexing the nurse's schedule to maintain a 40 hour work week.
9.14.3 The Association and the District concur that overtime should be minimized. All overtime, compensatory time, and excess hours should, to the maximum extent possible, be pre-approved by the nurse’s supervisor or designee. However, it is recognized that, due to the non-availability of the supervisor/designee or circumstances beyond the control of the nurse, pre-approval may not be possible in all instances. When pre-approval is not possible and hours above the nurse’s FTE are worked, the nurse will notify his/her supervisor/designee as soon as practicable. If the additional hours were not pre- authorized, the supervisor may ask that the hours be flexed during the remainder of that work week, or the additional hours become compensatory time.
9.14.4 No nurse shall have more than eighty (80) of actual work (120) hours of compensatory time on the books. Compensatory time may be selected at the nurse's discretion and may be taken at times mutually agreed to by the District and the nurse.
Compensatory Time/Overtime. Employees will be compensated by compensatory time on a straight time basis for work specifically assigned either on a non workday or beyond the scheduled hours on a normal workday. The accrual of compensatory time will be limited to eighty (80) hours and employees will be paid at the straight time rate for any excess. An employee at his/her option in any given pay period may elect to receive straight time monetary compensation or compensatory time for overtime hours whenever the compensatory time accrued is less than eighty (80) hours. All hours worked on the first and second off-duty day shall be compensated at the overtime rate set forth herein; provided that the employee has worked forty (40) straight-time hours during the regularly scheduled workweek. Notwithstanding other sections of the Agreement that may conflict with this section, for the purposes of calculating the employee’s forty (40) hour workweek, only one of the following approved exceptions may be credited towards the employee’s scheduled workweek:
1. One
(1) Vacation Day; or
2. One (1) Floating Holiday; or
3. One

For shows other than those defined in B below: Employees shall be eligible to receive compensatory time off (“Comp time”) when working outside of their normal scheduled hours. The guidelines for the accrual and use of comp days for employees eligible under this provision are as follows:
1. Employees shall accrue compensatory time off when required to work on a weekend day, or evenings that involve four (4)+ hours in excess of their scheduled work hours.
2. Comp time accrual should be approved by the employee's manager ahead of time.
3. To schedule and take accrued Comp time, employees need approval from their manager.
4. Employees shall not be required to perform work while taking approved Comp time.
5. Employees must affirmatively attempt to take accrued Comp time within three (3) months of accruing the time, or the time shall be forfeited. If the Employee attempts to take the time off, but the employee's supervisor or manager can't agree on specific time off within six (6) months of the date of accrual, then the employee shall designate their time off in the period from six (6) months to nine (9) months from its accrual.

The Company shall continue this approach, whether formal or informal, for bargaining unit employees on the same basis and terms as non-bargaining unit employees. The Company shall comply with all applicable federal, state, and/or local laws regarding overtime.
