Overtime/Compensatory Time. ESP
1. Overtime and compensatory time must be approved by administration, before it takes place. After 40 hours of actual work per week, overtime or compensatory time will be figured at time and a half. Overtime and compensatory time will be based on actual hours worked in a work week. Payments that are made for occasional periods when the ESP is not at work due to vacation, holiday, illness, or other similar cause are not treated as hours worked for overtime purposes of computing overtime. Neither are such hours credited towards overtime.
2. In computing any overtime for ESPs, excluding bus drivers, one-half hour per workday will be deducted as non-work time before overtime goes into effect because one-half hour per day is paid lunch during which those ESPs do not work. ESPs shall have a 30-minute duty-free lunch and ESPs do not ever have to work through his/her lunch. In computing any overtime for bus drivers, only the hours per day the bus driver actually works out of the four-hour paid workday will be included in the hours calculated for overtime or compensatory time since bus drivers are paid for four hours per day, but typically work approximately three hours per day.
3. Compensatory time earned by an ESP may accrue up to 240 hours. This is 160 hours of actual overtime work. Overtime beyond this limit shall be paid as overtime pay. Compensatory time earned must be used within the same fiscal year.
4. Any ESP who is called in to work will be paid for hours worked.
5. Hour–for-Hour Work Time Trade An administrator may require an educational support employee to work extra time during the work week and trade those work hours for regular work hours (hour-for-hour), so the workweek does not exceed forty weekly work hours.
Overtime/Compensatory Time. All hours worked in excess of an employee's scheduled work day or activity period shall be compensated at one and one-half (1-1/2) times their normal rate of pay or, at the Employer's option, be credited with compensatory time at the time and one-half (1-1/2) rate. Notwithstanding other portions of this section, all unscheduled overtime not abutting an employee's scheduled shift shall be taken in premium pay or compensatory time at the employee's option. Compensatory time balances may not exceed eighty (80) hours. Employees will be paid for any overtime, which would cause the compensatory bank to exceed eighty (80) hours budget permitting. The Employer reserves the right to schedule employees off on compensatory time at a time and date mutually agreeable to the employee and the Employer. The Employer scheduled compensatory time off shall not reduce an employee's balance below thirty-two (32) hours, unless a lesser balance is mutually agreed to. Compensatory time may be taken in one (1) hour increments with approval.
