Common use of Completion of Construction Clause in Contracts

Completion of Construction. Developer shall complete construction of the Public Improvements no later than eighteen (18) months from the commencement of the construction, unless such completion date is extended for reasons beyond the reasonable control of Developer and Developer has obtained the Town’s written consent to the extension.

Completion of Construction. Subject to the provisions of the approved Phasing of Public Improvements defined herein, Developer shall complete construction of the Public Improvements no later than eighteen (18) months from the commencement of the construction, unless such completion date is extended for reasons beyond the reasonable control of Developer and Developer has obtained the Town’s written consent to the extension.

Notwithstanding the foregoing or anything herein to the contrary, in the event of a Force Majeure Event and upon Developer’s written notice to the Town, the deadline to complete construction of the Public Improvements will be automatically extended on a day-for-day basis for as long as the Force Majeure Event remains in effect.
