Common use of Completion of the Utilisation Request Clause in Contracts

Completion of the Utilisation Request. The Utilisation Request is irrevocable and will not be regarded as having been duly completed unless: (a) the proposed Utilisation Date is a Business Day within the Availability Period; (b) the currency and amount of the Utilisation comply with Clause 5.3 (Currency and amount); and (c) the proposed Interest Period complies with Clause 9 (Interest Periods).

Completion of the Utilisation Request. (a) The Utilisation Request is irrevocable and will not be regarded as having been duly completed unless: (ai) the proposed Utilisation Date is a Business Day within the Availability Period; (bii) the currency and amount of the Utilisation comply with Clause 5.3 (Currency and amount); and (ciii) it provides that the proposed Interest Period complies with Clause 9 proceeds of the Utilisation shall be disbursed into the Closing Account (Interest Periodsor such other account as the Lender may agree). (b) Only one (1) Loan may be requested in the Utilisation Request.

(a) The Utilisation Request for the Loan is irrevocable and will not be regarded as having been duly completed unless: (ai) the proposed Utilisation Date is a Business Day within the Availability Period; (bii) the currency and amount of the Utilisation comply with Clause 5.3 (Currency and amount); and (ciii) the proposed Interest Period complies with Clause 9 11 (Interest Periods). (b) Only one Utilisation may be requested in the Utilisation Request.

(b) Only one Advance under each of Tranche A, Tranche B, Tranche C, Tranche D and Tranche E may be requested in the Utilisation Request.

The Utilisation Request is irrevocable and will not be regarded as having been duly completed unless: (ai) the proposed Utilisation Date is a Business Banking Day within the Availability Period;; and (bii) the currency and amount of the Utilisation comply with Clause 5.3 (Currency and amount); and (c) the proposed Interest Period complies with Clause 9 (Interest Periods).
