Common use of Completion Tests Clause in Contracts

Completion Tests. At least 30 (thirty) days prior to the likely completion of the Construction Works for Project or any Phase thereof (namely, Phase-0 and/or Phase-I and/or Phase-II and/or Phase-III and/or Optional Development), as the case may be, the Concessionaire shall notify the Independent Engineer and/or the Independent Panel, as the case may be, of its intent to subject the Project or any phase thereof to Completion Tests. The date and time of each Test shall be determined by the Independent Engineer and the Independent Panel, as the case may be, in consultation with the Concessionaire, and notified to the Authority who may designate its representative to witness the Completion Tests. The Concessionaire shall provide such assistance as the Independent Engineer and/or the Independent Panel, as the case may be, may reasonably require for conducting the Completion Tests. In the event of the Concessionaire, the Independent Engineer and/or the Independent Panel, as the case maybe, failing to mutually agree on the dates for conducting the Completion Tests, the Concessionaire shall fix the dates by not less than 7 (seven) days' notice to the Independent Engineer and/or the Independent Panel, as the case may be.
