Common use of Compliance and Payments Clause in Contracts

Compliance and Payments. The Borrowers' compliance with this Section 3.7 shall be tested at any time and from time to time by the Administrative Agent at its sole discretion, but in any event shall be tested on (A) the date on which either Borrower requests the Lenders issue or extend a Letter of Credit and (B) the date an interest payment is due under Section 5.1(d). Each such repayment pursuant to this Section 3.7 shall be accompanied by any amount required to be paid pursuant to Section 5.9."

The Borrowers' compliance with this Section 3.7 2.6(b) shall be tested at any time and from time to time by the Administrative Agent at its sole discretion, but in any event shall be tested on (A) the date on which either any Borrower requests that the applicable Lenders make a Revolving Credit Loan, Alternative Currency Loan or Swingline Loan or the Issuing Lender issue or extend a Letter of Credit under Section 6.3 and (B) the date an interest payment is due under Section 5.1(d5.1(e). Each such repayment pursuant to this Section 3.7 2.6(b) shall be accompanied by any amount required to be paid pursuant to Section 5.95.12."

The Borrowers' Borrower’s compliance with this Section 3.7 2.5(b) shall be tested at any time and from time to time by the Administrative Agent at its sole discretion, but in any event shall be tested on (A) the date on which either the Borrower requests the Lenders to make a Revolving Credit Loan or the Alternative Currency Lender to make an Alternative Currency Loan or the Issuing Lender to issue or extend a Letter of Credit and (B) the date an interest payment is due under Section 5.1(d4.1(e). Each such repayment pursuant to this Section 3.7 2.5(b) shall be accompanied by any amount required to be paid pursuant to Section 5.94.11 hereof."
