Common use of COMPLIANCE WITH COLLECTIVE BARGAINING AGREEMENTS Clause in Contracts

COMPLIANCE WITH COLLECTIVE BARGAINING AGREEMENTS. Notwithstanding any other provision hereunder, if Contractor is subject to any collective bargaining agreement(s) requiring compliance with a pre-established applicant referral process, Contractor’s only obligations with regards to any available Entry Level Positions subject to such collective bargaining agreement(s) during the term of the Contract shall be the following: a. Contractor shall notify the appropriate union(s) of the Contractor’s obligations under this Agreement and request assistance from the union(s) in referring Qualified applicants for the available Entry Level Position(s), to the extent such referral can conform to the requirements of the collective bargaining agreement(s). b. Contractor shall use “name call” privileges, in accordance with the terms of the applicable collective bargaining agreement(s), to seek Qualified applicants from the System for the available Entry Level Position(s). c. Contractor shall sponsor Qualified apprenticeship applicants, referred through the System, for applicable union membership.
