Compliance with Construction Documents and Contracts. Borrower shall cause Mortgage Borrower to abide by, perform and comply with all of Mortgage Borrower’s material obligations under the Architect Agreement, the General Contractor Agreement, the Trade Contracts, the other Construction Contracts and the Construction Documents to which Mortgage Borrower is a party, and Borrower, at its sole cost and expense, shall cause Mortgage Borrower to use all Commercially Reasonable Efforts to secure or enforce the performance of each and every material obligation, covenant, condition and agreement to be performed by the other parties thereunder.
