Compromise and Support. This Settlement Agreement is a negotiated compromise of issues and is broadly supported by parties who are gas producers, marketers, shippers, independent storage providers, wholesale and retail end-use customers, and regulatory representatives. Nothing contained herein shall be deemed to constitute an admission or an acceptance by any party of any fact, principle, or position contained herein. Notwithstanding the foregoing, the Settlement Parties, by signing this Settlement Agreement and by joining the Application requesting Commission approval of this Settlement Agreement, acknowledge that they pledge support for Commission approval and subsequent implementation of these provisions. Subject to Rule 12 of the CPUC Rules of Practice and Procedure, Rule 601 et seq. of the FERC Rules of Practice, Rule 408 of the Federal Rules of Evidence, and Section 1152 of the California Evidence Code

Notwithstanding the foregoing, the Settlement Parties, by signing this Settlement Agreement and by joining the motion to adopt the Settlement Agreement filed before the Commission, acknowledge that they pledge support for Commission approval and subsequent implementation of these provisions.
