Condition to Transmission Owner’s Obligation to Build. It is a condition to the Transmission Owner’s obligation to commence construction of any upgrades under this Agreement that Transmission Owner has received all applicable permits, licenses, and authorizations from Governmental Authorities for the commencement of such construction in accordance with the requirements of Section 3.1.2.
