Conditions Precedent to City’s Obligations. In addition to any other conditions contained in this Agreement, the conditions set forth in this Section 6.1 must be satisfied prior to the City’s obligation to acquire the Property Interest. These conditions are intended solely for the City’s benefit and the City has the sole right and discretion to waive, by written notice, any of the conditions. In the event any condition is not satisfied or waived on or before Closing, the City will have the right to terminate this Agreement, in which event the Xxxxxxx Money shall promptly be returned to the City.
