Conditions to Lender. S OBLIGATIONS TO MAKE THE LOAN The conditions listed below are precedent to any obligations of the Lender and shall be complied with in form and substance satisfactory to Lender and its counsel prior to the Lender's obligation to advance any portion of the Loan:
Conditions to Lender s Obligations under this Agreement. Notwithstanding any other provision of this Agreement, Lender shall have no obligations under the Agreement unless and until the Borrower shall have duly executed and delivered to Lender the Note and Warrant Agreement, each dated as of the Closing Date.
