Common use of CONDUCTING THE LOTTERY Clause in Contracts

CONDUCTING THE LOTTERY. New Start-Up Charter Schools Charter schools must enroll all students who wish to attend the school unless the number of students exceeds the capacity of a program, class, grade level or building. If capacity is insufficient to enroll all students who wish to attend the school based on initial application to the school, the charter school must select students through a lottery. At the conclusion of the application period, if the applications for students do not exceed the slots available, students applying during the application period shall be admitted. If the total number of eligible applicants exceeds the capacity of a program, class, grade level, or building, admission to the program, class, grade level, or school shall be based on an admissions lottery conducted from among the total number of eligible applicants.
