Confirmation of Original Indenture. Except as amended and supplemented hereby, the Indenture is hereby ratified, confirmed and reaffirmed in all respects. The Indenture and this Supplemental Indenture shall be read, taken and construed as one and the same instrument.

As supplemented by this First Supplemental Indenture, the Original Indenture is in all respects ratified and confirmed, and this First Supplemental Indenture shall be read, taken and construed as a part of the Indenture so that all of the rights, remedies, terms, conditions, covenants and agreements of the Original Indenture shall apply and remain in full force and effect with respect to this First Supplemental Indenture and to the Series B Debentures issued hereunder.

Nothing in this Fourth Supplemental Indenture shall be deemed to amend the Original Indenture as supplemented by the First Supplemental Indenture, as further supplemented by the Second Supplemental Indenture and as further supplemented by the Third Supplemental Indenture with respect to the Initial Debentures, the Series B Debentures and the Series C Debentures. Subject to the foregoing, the Original Indenture, as supplemented by the First Supplemental Indenture, as further supplemented by the Second Supplemental Indenture, as further supplemented by the Third Supplemental Indenture and as further supplemented by this Fourth Supplemental Indenture shall be and continue in full force and effect and is hereby confirmed.

Confirmation of Original Indenture. As supplemented by the First Supplemental Indenture, the Second Supplemental Indenture and this Third Supplemental Indenture, the Original Indenture, is in all respects ratified and confirmed, and this Third Supplemental Indenture shall be read, taken and construed as a part of the Indenture so that all of the rights, remedies, terms, conditions, covenants and agreements of the Indenture shall apply and remain in full force and effect with respect to this Third Supplemental Indenture and to the Series D Subordinated Debt Securities issued hereunder.

As supplemented by the First Supplemental Indenture and this Second Supplemental Indenture, the Original Indenture, is in all respects ratified and confirmed, and this Second Supplemental Indenture shall be read, taken and construed as a part of the Indenture so that all of the rights, remedies, terms, conditions, covenants and agreements of the Indenture shall apply and remain in full force and effect with respect to this Second Supplemental Indenture and to the Series C Debentures issued hereunder.

The Original Indenture, as heretofore supplemented and amended by the First Supplemental Indenture, the Second Supplemental Indenture, the Third Supplemental Indenture, the Fourth Supplemental Indenture, the Fifth Supplemental Indenture, the Sixth Supplemental Indenture and this Seventh Supplemental Indenture, is in all respects ratified and confirmed, and the Original Indenture, the First Supplemental Indenture, the Second Supplemental Indenture, the Third Supplemental Indenture, the Fourth Supplemental Indenture, the Fifth Supplemental Indenture, the Sixth Supplemental Indenture and this Seventh Supplemental Indenture and all indentures supplemental thereto shall be read, taken and construed as one and the same instrument.
Confirmation of Original Indenture. The Original Indenture, as supplemented by a first supplemental indenture dated as of October 20, 2010 between the Company and the Canadian Trustee, as further supplemented by the Second Supplemental Indenture, as further supplemented by a third supplemental indenture dated as of August 17, 2012 between the Company and the Canadian Trustee, as further supplemented by a fourth supplemental indenture dated as of November 29, 2012 between the Company, the Canadian Trustee and Computershare Trust Company, N.A. (the “U.S. Trustee”), as further supplemented by a fifth supplemental indenture dated as of December 10, 2012 between the Company, the Canadian Trustee and the U.S. Trustee, and as further supplemented by this Sixth Supplemental Indenture shall be and continue in full force and effect and is hereby confirmed.
