Consent to access. The administration of this contract will entail the use of the web-based portal described in paragraph D.
1. The contractor agrees that use of the portal is to be considered authorization to allow the contractor retained for the purpose of operating and maintaining the portal access to any data submitted (including cost and pricing data, data the contractor might otherwise consider proprietary and data that meets the definition of “trade secret” as used in the context of 18 USC 1905). The consent to access that is to be inferred for the use of the portal shall also be granted by any subcontractor or team member who makes a direct submission of information to the Government. The Government shall consider submission of data via the portal to be consent to access only by the portal administrative contractor. The current portal administrative contractor is Octo Consulting.
Consent to access. 8.1. Customer hereby authorizes INAP to access one or more remote computer systems owned, leased by, or under the control of Customer (each a “Customer System”) for purposes of providing the Management Services and all other tasks necessary for the performance of the Management Services. A Customer System may be, and is not limited to, a virtual machine or server provided by an entity other than INAP, an on-premises server at Customer’s location, or any other computer system that INAP is able to manage remotely. Customer hereby authorizes INAP to install and execute special remote management software within each Customer System covered by the Management Services, as determined by INAP to be necessary for the performance of the Management Services.
8.2. Customer hereby waives all claims, both at law and at equity, against INAP arising from any access by INAP to any Customer System, such claims including but not being limited to claims brought under the Computer Fraud and Abuse Act, the Stored Communications Act, the Electronic Communications Privacy Act, and all applicable foreign and state laws governing the access to or use of computer systems and data. Customer hereby acknowledges and agrees that such waiver is necessary to provide INAP with the assurances necessary for it to be able to competently provide the Management Services to Customer.
Consent to access. From and at all times after the execution of this Agreement, including for avoidance of doubt, at all times after the Closing Date, VN hereby acknowledges, agrees directs, and consents to any and all third parties disclosing any and all non-public, confidential and/or other information of any type or kind whatsoever of, or relating to, the Purchased Assets.
Consent to access. No Member may physically enter a property without notification to, and express approval of, the listing Member unless the showing instructions provide otherwise.
